Integration of Artificial Intelligence in Constitutional Democracies: Conceptual Challenges and Regulatory Proposals

Abstract

This investigation examines the critical intersection between advancements in artificial intelligence (AI) and the foundational principles underpinning contemporary constitutional democracies. Through  an interdisciplinary approach, it integrates perspectives from state theory, legal philosophy, and technological studies to analyze how the incorporation of algorithmic systems into governmental and social processes is transforming traditional power structures. The analysis highlights that, in the absence of adequate regulation, the adoption of these technologies may create normative gaps that facilitate the erosion of democratic oversight and compromise accountability mechanisms. Considering this scenario, the essay emphasizes the urgency of rethinking and adapting constitutional frameworks for the digital era, proposing new governance mechanisms capable of mitigating the disruptive effects of technology. It argues that updating these frameworks is essential to preserving the rule of law and ensuring that the transformations driven by AI strengthen, rather than weaken, the democratic foundations. Ultimately, the work invites a profound reflection on the need to strike a balance between technological innovation and the protection of democratic values, ensuring that progress in AI contributes to the development of a more just and regulated society.
